TOUGHER LIMITS
  • Lowers the Blood Alcohol Content at which a driver is presumed intoxicated from .10 to .08
  • Establishes Blood Alcohol Content for drivers under age 21 at .02 for license suspension
  • Out-of-state convictions considered in sentencing
  • Allows courts to look back 10 years for previous offenses

  • Mandates immediate confiscation of license upon breath test failure or refusal
  • Punishes first offense with up to 2 1/2 years in jail and fines of up to $5000
  • Classifies third offense and beyond as a felony conviction
  • Increases minimum and maximum penalties for all repeat offenses
